In view of the forthcoming trialogues on the Proposal for a Directive on representative actions for the protection of the collective interests of consumers, and repealing Directive 2009/22/EC, AFEP shares its key messages for the negotiations.
French companies recommend that the co-legislators:
- Stick to the Commission and Parliament approach on the definition of actions so as to avoid fragmentation
- Better frame qualified entities and strongly control their funding
- Guaranty a balanced system between consumer protection and legal certainty for companies
