AFEP member companies support the text’s objective of innovation but call for a balance to be found between sharing obligations and maintaining innovation
AFEP member companies support the objective of the Data Act to stimulate innovation through better access to data from connected objects and the consideration of principles favourable to a fairer market.
However, companies regret the absence of a detailed impact assessment identifying market failures justifying this data sharing. Additional work is therefore needed on the following points:
- Clarification regarding the definition of data, the scope of this Regulation and the products covered.
- Ensuring proportional and fair compensation as well as sufficient safeguards to protect intellectual property rights and trade secrets of European stakeholders and maintain incentives for innovation.
