Collective Redress Directive – AFEP Position

Within the package on consumer law (“New Deal for Consumers”) published on 11 April 2018, the European Commission has included a proposal for a Directive “on representative actions for the protection of the collective interests of consumers”. AFEP considers that it is necessary to broadly amend the text in order to create a system that offers an effective protection to consumers in the framework of a harmonised procedure where the rights of the parties are balanced and protected by effective and comprehensive safeguards drawing on the best practices of the existing judicial systems.
